Workers' compensation benefits are available to any employee suffering from an occupational illness or an injury sustained in a work-related accident. Through the workers' compensation system, injured or ill employees have the right to seek benefits for their medical expenses, lost wages, and permanent disability (if their injuries or illness is permanent).

All employers who employ three or more employees are required to carry workers' compensation insurance.  When a workers' compensation claim is approved, the employer is responsible for paying the employee two-thirds of his/her average weekly pay, as well as all approved medical bills.  If the employee is suffering from a permanent injury, the employer is required to pay the employee for that as well, the amount of which is determined by which body parts have become impaired as well as the extent of the impairment.

Workers' Comp Denials

If an employee's workers' compensation claim is denied by their employer or insurance carrier, there are steps that can be taken to appeal.  First, the employer or insurance company is required to file a Form 61, with a detailed explanation as to why they denied the claim.  The employee can then appeal the denial by requesting a hearing with a Deputy Commissioner from the North Carolina Industrial Commission.  This is done by the employee filing a Form 33.   If the deputy commissioner upholds the denial, there are additional steps the employee can take to try an appeal the decision.  Please click here for more information about workers' compensation denials.
