Workers' compensation benefits are available to employees who have suffered an injury while at work or who are suffering from an occupational illness. As long as your injury or illness meets the requirements in the Workers' Compensation Act, you are eligible to recover benefits for:
Wage Replacement: If an employee is unable to work because of his/her injury or occupational illness, he/she is entitled to two-thirds of their average weekly wage, tax-free. This compensation is to be paid until the employee is able to return to work.
Medical Expenses: Under North Carolina workers' compensation law, employers are required to pay all medical expenses in the event their employee suffers a work-related injury or illness. The law states that the medical provider cannot charge the employee for any medical services rendered. All charges must be billed to the employer, who is required to pay 100% of all approved medical bills.
Permanent Disability: If an employee suffers a permanent injury or becomes permanently impaired due to a work-related accident or occupational illness, the employer is required to pay the employee for his or her permanent condition. The amount the employer is required to pay is based on the extent of the impairment and which body part has been impaired.
Death Benefits: If an employee dies due to a work-related accident or occupational illness, his/her dependants are entitled to death benefits.
